Privacy Policy

Academic Frustration Intervention Tool Ltd., operating as AFit Learning ("AFit Learning," "AFit," "we," "us," or "our"), provides the AFit online learning assessment, the Student Orientation to School Questionnaire (SOS-Q), and the websites at www.afitlearning.com and app.afitlearning.com (together, the "Service"). This Privacy Policy explains what personal information we collect, how we use and share it, and the choices and rights you have.

Because the Service is used to assess and support children, we take the protection of student information especially seriously. If you have questions, contact our Privacy Officer at tim@afitlearning.com.

 

1. Who this policy applies to

  • Parents and guardians who create accounts to assess and support their own children, including homeschooling families.
  • Schools, school boards, and their staff (teachers, administrators, and support staff) who use the Service with students.
  • Students who complete assessments or questionnaires under the supervision of a parent, guardian, or educator.
  • Visitors to our website who browse, fill out a form, book a demo, or download our materials.

 

2. Schools and school boards

When a school or school board ("School") uses the Service, the School decides which students take part and controls the student information entered into the Service. In that case, we process student information on the School's behalf, according to our agreement with the School and the privacy laws that apply to the School. Parents and students of a participating School should direct requests about their information to the School first, and we will help the School respond.

 

3. Information we collect

Information you give us

  • Account information: name, email address, password, role (for example, parent or teacher), school or organization name, and similar details.
  • Student profile information: the student's name or identifier, date of birth, grade level, school, and any other details a parent, guardian, or educator chooses to add. For SOS-Q, the School also provides the student's email address and gender so the questionnaire can be delivered and results compared with appropriate norms.
  • Assessment information: for the AFit assessment, the educator's or parent's observation ratings of the student, scores, and the resulting results about strengths, learning needs, and frustration patterns in literacy, numeracy, and cognition, along with recommended strategies and feedback on how well those strategies worked. For SOS-Q, the student's answers to the questionnaire and the resulting scores.
  • Payment information: card payments are handled by our payment processor, Stripe. We receive limited details such as your name, billing address, and the last four digits of your card. We do not store full card numbers. If you pay by electronic funds transfer (EFT) through a Canadian financial institution, we receive the payment details needed to process and record your payment.
  • Communications: information you send us when you contact us, request a demo, fill out a form, or download our brochure.

Information collected automatically

  • Usage and device information: IP address, browser type, device type, pages viewed, links clicked, and the dates and times of your visits.
  • Cookies and similar technologies: our public website uses cookies and tracking tools, including HubSpot and Google Tag Manager, to run the site, remember your preferences, understand how visitors use the site, and measure our marketing. These tools are not used on the pages where student information is displayed. See Section 8 for your choices.

 

4. How we use information

We use personal information to:

  • provide, operate, and maintain the Service, including delivering assessments, questionnaires, and results;
  • generate personalized, research-based strategies and track a student's progress over time;
  • create and manage accounts and verify identity;
  • process payments and manage subscriptions;
  • respond to questions and provide customer support;
  • send service-related messages, such as account notices, questionnaire invitations to students, and updates;
  • send marketing messages to adult users who have agreed to receive them (you can unsubscribe at any time);
  • improve the Service and develop new features, using de-identified or aggregated information wherever possible;
  • improve our intervention recommendations. We train the model that suggests strategies using de-identified assessment data. Before any record is used, we remove the student's name, school, teacher, and all account identifiers, replace the record ID with a random token that is discarded after training, and convert date of birth to age. The model contains no individual student records, we do not attempt to re-identify anyone, and training data is not shared with third parties. Schools may opt out of this use in their agreement with us, and parents may opt out on the consent form provided by their school;
  • keep the Service secure and prevent fraud or misuse; and
  • comply with legal obligations.

What we do not do: We do not sell personal information. We do not use student information for targeted advertising, and we do not build marketing profiles of students.

 

5. Consent

We collect, use, and share personal information with consent, except where the law permits or requires otherwise. A student's information is entered into the Service by, or with the authorization of, their parent, guardian, or School. We do not knowingly allow children to create their own accounts. If you believe a child has given us personal information without proper authorization, please contact us and we will delete it.

You may withdraw your consent at any time, subject to legal or contractual limits. Withdrawing consent may mean we can no longer provide some or all of the Service.

6. How we share information

  • Within your account: results are visible to the parent, guardian, or authorized School staff linked to the student.
  • Service providers: companies that help us run the Service. They may use the information only to perform services for us and must protect it. They are listed in Section 7.
  • Legal reasons: when required by law, court order, or government request, or to protect the rights, safety, or property of students, users, AFit Learning, or others.
  • Business transfers: if we are involved in a merger, acquisition, or sale of assets, personal information may be transferred, and the new owner will be required to protect it in line with this policy.
  • De-identified data: we may use and share information that has been aggregated or de-identified so it cannot reasonably identify any individual.

 

7. Where information is stored and who processes it

We are based in Alberta, Canada. The Service is hosted on Amazon Web Services in its Canada (Central) region, so account, student, and assessment information is stored in Canada.

The following service providers process information on our behalf. Some operate outside Canada, where information may be subject to the laws of that country. We use contractual and other safeguards to protect information handled by these providers.

8. Cookies and your choices

You can set your browser to refuse or delete cookies. If you do, some parts of the website may not work properly. You can opt out of marketing emails using the unsubscribe link in any email.

 

9. How we protect information

We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and at rest, multi-factor authentication for staff with administrative access, logging of access to student information, access limited to staff who need it, and secure hosting in Canada. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a privacy breach creates a real risk of significant harm, we will notify affected individuals, Schools, and regulators as required by law.

 

10. How long we keep information

We keep personal information only as long as needed for the purposes in this policy, to meet our agreements with Schools, or as required by law. Schools may ask us to delete their students' information at any time, and we complete deletion within four weeks of a written request.

 

11. Your rights

Subject to applicable law, you may:

  • ask for access to the personal information we hold about you or your child;
  • ask us to correct information that is inaccurate or incomplete;
  • ask us to delete information;
  • withdraw consent; and
  • ask questions or make a complaint about how we handle information.

To make a request, email tim@afitlearning.com. We may need to verify your identity first. We will respond within the time required by law. If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner of Alberta or the Office of the Privacy Commissioner of Canada.

Users outside Canada: if you live elsewhere, such as the United States or the European Union, you may have additional rights under local law (for example, the U.S. Children's Online Privacy Protection Act). Contact us to exercise them.

 

12. Third-party links

Our website links to third-party sites and social media, including Facebook, LinkedIn, Instagram, YouTube, and TikTok. We are not responsible for their privacy practices. Please review their policies before sharing information with them.

 

13. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and change the effective date above. If we make significant changes, we will notify account holders by email or through the Service before the changes take effect.
